The Bombay High Court has granted bail to a businessman who was arrested with 1.01kg of charas, after the weight of the seized contraband measured before a magistrate two months later was found to be 10 grams less. The court considered the weight measured before the magistrate as part of procedural compliance and concluded that it was an intermediate, non-commercial quantity. The court also noted that the delay in drawing samples before the magistrate was beyond the control of the investigating agency. The trial is yet to commence, and the accused has no criminal antecedents.
