Why Date of Birth Correction Matters
A correct date of birth (DOB) on official documents is critical for every aspect of life — school admissions, employment, passport issuance, retirement benefits, insurance, and legal proceedings. An incorrect DOB can cause significant complications. Unfortunately, DOB errors are surprisingly common, especially in older documents issued before digitization. The correction process varies depending on which document has the error and the availability of primary evidence (birth certificate).
In India, the Births, Deaths and Marriages Registration Act, 1969 governs birth registration. The birth certificate issued under this Act is the primary and most authoritative proof of date of birth. All other documents derive their evidentiary value from the birth certificate or secondary evidence accepted by the issuing authority.
Correcting Date of Birth in Birth Certificate
If the error is in the birth certificate itself — the most fundamental document — the correction must be made at the municipal corporation or registrar's office where the birth was originally registered. The process under the Registration of Births and Deaths Act:
- Visit the office of the Registrar of Births and Deaths (municipal corporation/gram panchayat) where the birth was registered.
- Obtain the prescribed application form for correction in birth records.
- Submit a written application stating the incorrect entry and the correct date of birth along with the reason for the correction.
- Attach documentary evidence of the correct DOB: hospital discharge summary, vaccination card, school leaving certificate, baptism certificate, or any contemporaneous document showing the correct date.
- Submit an affidavit on stamp paper declaring the correct date of birth and explaining the error.
- Pay the prescribed fee (varies by municipality, typically ₹100-500).
- The registrar will verify the records and may conduct an inquiry.
- Once approved, the corrected birth certificate is issued — this can take 15-45 days depending on the complexity.
Court Process for DOB Correction (If Registrar Denies)
If the municipal registrar refuses to correct the birth record or the birth was never registered, you may need to approach the civil court. File a declaratory suit under Section 34 of the Specific Relief Act, 1963, seeking a declaration of the correct date of birth. The court will examine all available evidence — school records, medical records, horoscope, vaccination cards, and witness testimony. If satisfied, the court issues a declaratory decree of the correct DOB, which is binding on all authorities.
Correcting DOB in Aadhaar Card
Aadhaar DOB corrections are relatively straightforward:
- Log in to the UIDAI Self-Service Update Portal (myaadhaar.uidai.gov.in).
- Select 'Date of Birth Update' and enter the correct DOB.
- Upload Proof of Date of Birth — birth certificate, SSLC book/certificate, passport, or PAN card showing the correct DOB.
- Pay ₹50 fee and submit.
- For major corrections (more than 3 years difference), you may need to visit an Aadhaar Seva Kendra.
Correcting DOB in PAN Card
PAN card DOB corrections can be done through the NSDL or UTIITSL portal. Fill the 'Request for New PAN Card or/and Changes in PAN Data' form. Attach proof of correct DOB — birth certificate, Aadhaar (updated), passport, or matriculation certificate. The fee is ₹110 for Indian addresses. The corrected PAN card is dispatched within 15-20 days.
Correcting DOB in Passport
Passport DOB correction requires an application for re-issue of passport at the Passport Seva Kendra. Submit the old passport, birth certificate (corrected), updated Aadhaar, and a notarized affidavit explaining the discrepancy. The passport officer may call for an interview. If the DOB difference is significant (more than 2 years), a court order or gazette notification may be required.
Correcting DOB in Educational Certificates
Educational certificates (10th, 12th, degree) have specific correction procedures: CBSE allows corrections within 2 years of issuance with supporting documents. For older certificates, a court order confirming the correct DOB is typically required by universities and state boards. Contact the respective board/university's examination department with a written application, affidavit, and primary evidence of the correct DOB.
⚠️ Important: Under the Indian Evidence Act, the birth certificate issued under the Registration of Births and Deaths Act is primary evidence of date of birth. All other documents are secondary evidence. If the birth certificate and educational certificate have conflicting DOBs, the birth certificate prevails — unless a court determines otherwise.
