Consumer Protection Act, 2019: An Overview
The Consumer Protection Act, 2019 (CPA 2019) is a comprehensive legislation that protects consumers against defective goods, deficient services, unfair trade practices, and misleading advertisements. The Act established a three-tier quasi-judicial mechanism: District Consumer Disputes Redressal Commissions (DCDRC) — for claims up to ₹50 lakh, State Consumer Disputes Redressal Commissions (SCDRC) — for claims between ₹50 lakh and ₹2 crore, and the National Consumer Disputes Redressal Commission (NCDRC) — for claims above ₹2 crore.

Who Can File a Consumer Complaint?
Under Section 2(7) of the CPA 2019, a 'consumer' is any person who: (1) Buys goods for consideration (paid or promised), (2) Hires or avails services for consideration, (3) Includes any user of such goods/services with the buyer's approval. The Act covers ALL sectors — banking, insurance, telecom, e-commerce, healthcare, real estate, education, travel, electricity, and hospitality. How to File a Consumer Complaint Online via e-Daakhil
- Visit edaakhil.nic.in — the official e-filing portal for consumer commissions.
- Register as a user with your mobile number and email ID. Complete the profile with your personal details.
- Select 'File New Complaint' and choose the appropriate commission based on the claim value and jurisdiction.
- Pecuniary Jurisdiction: District Commission (up to ₹50 lakh), State Commission (₹50 lakh to ₹2 crore), National Commission (above ₹2 crore). File in the commission having jurisdiction over the area where the opposite party resides/carries on business, OR where the cause of action arose, OR where the complainant resides.
- Fill the complaint form: (1) Complainant's details (name, address, contact), (2) Opposite Party details, (3) Facts of the case — chronological narrative explaining the defect/deficiency, (4) Cause of action and date, (5) Relief sought (refund, compensation, replacement, removal of deficiency, etc.), (6) Valuation of the complaint for jurisdiction and court fee.
- Upload the supporting documents: (a) Proof of purchase/transaction — invoice, receipt, bill, (b) Correspondence with the opposite party — emails, letters, (c) Warranty/guarantee cards (if applicable), (d) Photographs/videos of defective product or deficient service, (e) Expert opinion (if relevant), (f) Affidavit in support of the complaint, (g) Any other evidence supporting your claim.
- Pay the court fee online through the portal. The fee structure: District Commission — ₹200-2000 depending on claim value, State Commission — ₹2000-4000, National Commission — ₹5000.
- File the complaint. The portal generates a complaint number and acknowledgment.
- The commission examines the complaint for admissibility. If admitted, notice is issued to the opposite party through the portal (and by registered post).
- The opposite party must file their reply within 30 days (extendable by 15 days for sufficient cause).
- Both parties file evidence, and the commission fixes a date for hearing — these can be conducted via video conferencing through the e-Daakhil portal.
What Can You Claim in a Consumer Complaint?
Under Section 39 of the CPA 2019, the commission can order:
- Removal of defects from goods or deficiency in services.
- Replacement of defective goods with new goods free from defects.
- Refund of the price paid, along with interest.
- Compensation for any loss or injury suffered due to negligence of the opposite party.
- Discontinuation of unfair trade practices or restrictive trade practices.
- Withdrawal of hazardous goods from sale.
- Payment of punitive damages.
