What is the difference between domestic and international arbitration?

Domestic arbitration involves parties both based in India with the seat of arbitration in India. International arbitration involves at least one party from outside India or the seat is outside India. The enforcement framework differs — domestic awards under Section 36, foreign awards under Part II of the Arbitration Act.

How are arbitrators appointed?

The Arbitration Act allows parties autonomy to agree on appointment mechanism. If parties cannot agree, either party can apply to the High Court (for domestic arbitration) or the Supreme Court (for international arbitration) for appointment of arbitrators.

Can an arbitration award be challenged in court?

Yes. Domestic awards can be challenged under Section 34 on limited grounds: incapacity, invalid arbitration agreement, lack of proper notice, award beyond scope, composition of tribunal not as agreed, or award in conflict with public policy of India.

How long does international arbitration take?
