NDPS Act — Why Bail is So Difficult
The Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985 is India's toughest drug law. Section 37 creates a double condition for bail in commercial quantity cases: (1) the court must be satisfied there are reasonable grounds to believe the accused is NOT guilty, AND (2) the accused is not likely to commit any offence while on bail. Both conditions must be met — this is an exceptionally high bar.
